Hazardous Waste Manifests Are Going Electronic Reply

A hazardous waste manifest is an important set of paper forms that track hazardous waste shipments to their final destination.  As of June 30, 2018, those paper forms will become electronic, and must be entered into the EPA’s e-Manifest system!

The goal for going electronic is to have a more stream-lined, efficient, and automated system. The new electronic system will allow you to create, sign, and track hazardous waste manifests, all through the RCRAInfo system on the EPA’s Central Data Exchange (CDX) platform.  The new system is expected to go live on June 30, 2018.

It is important to note, if you do not already have an EPA identification number, you will need to obtain one and can do so through the RCRAInfo system. Also, for generators located in Massachusetts that currently have a Massachusetts ID number that starts with MV, you will need to obtain a new EPA ID number that is in the Federal format through the system.

There are a number of ways you can accomplish getting manifests into the e-Manifest system.  If you haven’t already become familiar with this new system, CAPACCIO recommends that you work closely with your waste hauler to help get your manifests into the e-Manifest system.

Going forward, the EPA will be imposing fees for manifests submitted which will be dependent upon the form in which they are remitted.  The fees are to recoup the costs of developing, operating, maintaining and upgrading the e-Manifest system, and will be levied as follows:

  • A paper manifest submitted to EPA = $20.00 per manifest
  • A PDF image of a manifest submitted electronically to EPA = $13.00 per manifest
  • A data file and PDF of a manifest submitted together to EPA = $7.00 per manifest
  • A manifest submitted via the EPA e-manifest system = $4.00 per manifest

There is a learning curve for understanding how to set up an account, how to get your electronic signature approval, and so on within the new system.  CAPACCIO can help you through this initial process and also know that your waste hauler is a reliable resource for advice on this as they are going through this process as well.  By contacting and working with them sooner rather than later, you can ensure a smooth transition for both parties as this new e-Manifest system is implemented.

It was six years ago that I was in Australia speaking to the Western Australian Cancer Council about the benefits of Toxics Use Reduction planning. CAPACCIO was asked to be the keynote speaker and present industry’s perspective and approach to TUR planning.  I remember feeling I had to share examples of both practical and amazing success stories so that those attending the conference would be motivated to “take-off” on their own TUR journeys and reap the benefits that we have seen from working on TUR Plans with our clients. How would I capture their attention…what would make them believe me…that’s where the “Cape” comes in…I came up with the “SUPER TURP cape” to have a schtick for my presentation… the truth is the folks who organized the conference said when they first saw me in the cape they thought “Who is this wacko we flew in from America”?  See, I got their attention! All in all, I was well received and helped spread the TUR Planning seed to the lower hemisphere.

CAPACCIO’s visit with the South Korean delegation on April 13

So CAPACCIO was thrilled when we were approached by the South Korean Ministry of Environment recently to meet with a delegation of 22 representatives from the ministry and corporations including Samsung, LG Chem, and Hyundai to discuss our experiences in developing TUR plans for our clients. South Korea will be enacting a TURA-like regulation which will become effective in 2019. They have decided to implement this regulation to reduce the amount of chemical accidents and to improve worker safety and health. They chose to visit us because CAPACCIO has six TUR Planners, more planners per square inch than any other firm in Massachusetts!

When the delegation arrived, our panel of TUR Planners was ready for their questions. It was so cool to be speaking to businesses from across the globe and realize how much we have in common and how much we can learn from each other. We made a real connection…for example, CAPACCIO’s mission is “Helping Industry and the Environment Prosper.” LG Chem, one of the delegates’, mission is “Balance between Business and Safety, Health and Environment,” which of course is very similar.  We sealed the new friendship when the Director of the Chemical Safety Management Team, from the Ministry of Environment, Bongwoo Shin, asked if he could don the official “Super TURP cape”. Others tried it on too. Who knows maybe a purple cape will lead to CAPACCIO helping with TUR Plans in South Korea! ISO 45001’s Purpose is to Improve Health and Safety Performance – But It Takes Some Planning Reply

As you may know ISO 45001 is here!  It was finalized and published in March of 2018.  But what is 45001?  It is an ISO standard for health and safety management systems (HSMS’s) that is designed to help organizations maintain a safe and healthy workplace, prevent ill health, manage an organization’s occupational health and safety (OHS) risks and opportunities, and continually improve the organization’s OHS performance.

Why is that important?  Along with certification to ISO 14001:2015 (ISO’s environmental management standard), certification to ISO 45001 serves as a commitment to the sustainability of the organization, its workers and other interested parties (e.g., investors, the local community).  This transparency of an organization helps to demonstrate its intentions and strategy in how the business conducts itself.  A commitment to OHS (occupational health and safety) carries a lot of weight with attracting talented workers, responsible customers, shareholders and others.

Now that ISO 45001:2018 is published, OHSAS 18001:2017 is being withdrawn, and organizations will no longer have the opportunity to become newly registered to the previous health and safety standard.  Organizations currently registered to OHSAS 18001:2007 have up to three years to transition to ISO 45001.  Organizations wanting to be newly registered will now only be able to register to the new ISO 45001 standard.

For those organizations that are already certified to ISO 14001:2015, many of the requirements you need should be in place for 45001 already – as the requirements for an EMS (environmental management system) are much the same as for an HSMS (health and safety management system).

If your organization is interested in forward thinking and seriously addressing its risks and opportunities in the area of OHS, it’s time to start planning how and when to get certified.

Tips on how to approach certification…

  • Be sure to obtain management commitment – without it the HSMS will fail (and it’s one of the requirements of the standard-See Element 5 of the standard).
  • Study the standard – look at what you have in place and what you need to put in place.
  • Set a schedule for the registrar to come in and audit your management system for certification. Your plan for certification should include a timetable that is reasonable for your organization.
  • Prepare, prepare, prepare – it’s not wise to wait until the last minute.
